Bloom provides general health education and organisational tools. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for care from your own clinician. In an emergency, call your local emergency number.
1. Agreement
These Terms of Service ("Terms") govern your use of the Bloom - Women's Health Suite ("Bloom", the "Service"), provided by BRK Services PLLC ("we", "us", or "our"), including the web applications at bloom-womens-health.com and the Bloom iOS application. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. What Bloom is, and what it is not
Bloom offers educational content, trackers and organisational tools relating to pregnancy, postpartum recovery, women's preventive health, adolescent health and surgical preparation. It includes an AI assistant that answers questions using published clinical guidance.
Bloom is not a medical device, does not practise medicine, and does not create a clinician–patient relationship between you and us. Content and AI responses are general information, may not apply to your circumstances, and may be incomplete or out of date. Always consult a qualified clinician about your own care, and never disregard or delay professional medical advice because of something you read in Bloom.
Bloom is not for emergencies. If you think you may have a medical emergency, call your local emergency number or go to the nearest emergency department.
3. Eligibility
You must be at least 13 years old to use Bloom. If you are under 18, you may use the Service only with the involvement of a parent or guardian, who agrees to these Terms on your behalf. You must have the legal capacity to enter into these Terms.
4. Your account
You are responsible for the accuracy of the information you provide, for keeping your sign-in credentials secure, and for activity that takes place under your account. Tell us promptly at support@brk-services.com if you believe your account has been used without your permission.
You may close your account at any time. See our Privacy Policy for how to request deletion of your account and the information held with it.
5. Memberships and payment
Some features require a paid membership. Prices and billing intervals are shown at the point of purchase. Payments are processed by Stripe; by purchasing, you also accept Stripe's terms.
Memberships renew automatically at the end of each billing period unless cancelled beforehand. You can cancel at any time, and your membership will continue until the end of the period you have paid for. Except where the law requires otherwise, payments are non-refundable. If you purchase through the Apple App Store, Apple's purchase and refund terms apply and cancellation is managed through your Apple account.
We may change prices. Changes will not affect the billing period you are already in, and we will tell you before a changed price takes effect.
6. Acceptable use
You agree not to:
- Use Bloom for any unlawful purpose, or in breach of these Terms.
- Attempt to gain unauthorised access to the Service, other users' accounts, or our systems.
- Interfere with or disrupt the Service, or circumvent rate limits or other technical restrictions.
- Copy, scrape, resell or redistribute Bloom's content except as these Terms allow.
- Use Bloom to provide medical advice to others, or present its output as professional clinical guidance.
- Upload anything unlawful, or anything you do not have the right to provide.
7. Your content
The information you enter into Bloom remains yours. You grant us the limited licence needed to store, process and display it so we can provide the Service to you — for example, storing your entries so they are available on your other devices, and sending your questions to our AI provider to generate a response. We handle this information as described in our Privacy Policy.
8. Our content
Bloom, including its software, text, design and clinical content, is owned by BRK Services PLLC or its licensors and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own health purposes. All rights not expressly granted are reserved.
9. Availability and changes
We aim to keep Bloom available but do not guarantee uninterrupted access. We may change, suspend or discontinue features, and may impose limits on use. We will give reasonable notice of material changes that adversely affect a paid membership.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service, its content, or any AI-generated response will be accurate, complete, current or suitable for your circumstances.
11. Limitation of liability
To the fullest extent permitted by law, BRK Services PLLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
12. Termination
You may stop using Bloom and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including sections 7 through 11 — will survive.
13. Changes to these Terms
We may update these Terms as Bloom changes. The current version will always be posted here with its effective date. Where a change is material, we will make reasonable efforts to notify you. Continuing to use the Service after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Davidson County, Tennessee, and you and we consent to the jurisdiction of those courts.
